Terms of Service

1. Introduction

Welcome to BiglyPay (“BiglyPay”, “we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of BiglyPay’s platform, modules, APIs, websites, and related services (collectively, the “Service”). By creating an account, integrating our modules, or using the Service, you agree to these Terms.

2. Acceptance of Terms

By registering or using the Service, you represent that you have read, understood, and agree to be bound by these Terms and any policies referenced herein (including our Privacy Policy). If you use the Service on behalf of an entity, you represent that you have authority to bind that entity.

3. Service Model (Non-Custodial)

BiglyPay is a non-custodial payment monitoring solution. Customer funds settle directly into wallets controlled by the merchant. We do not store private keys, and we do not take possession of customer or merchant funds.

BiglyPay provides detection, monitoring, reconciliation, and reporting for blockchain payments. Because funds do not flow through BiglyPay, you are responsible for the security of your own wallets and keys.

4. Eligibility & Compliance

  • You must comply with all applicable laws, including those related to financial services, sanctions, AML/CFT, and consumer protection in your jurisdiction.
  • You must not use the Service for prohibited activities (e.g., sanctions evasion, fraud, illegal goods/services).
  • We may implement risk controls (e.g., rate-limits, transaction monitoring) and may suspend access if we detect suspected abuse or legal risk.

5. Merchant Obligations

  • Accuracy: Provide accurate business details and keep them up to date.
  • Integrations: Configure integrations responsibly (WHMCS/HostBill/API) and secure your API keys, webhooks, and callback endpoints.
  • Customer Support: You are solely responsible for customer service to your buyers, including refunds, product delivery, and disputes.
  • Wallet Security: You control the wallets receiving payments. Keep backups and use proper operational security.

6. Fees & Credits

  • Service Fee: As published on our site (e.g., 0.5% for the non-custodial plan) and subject to change with notice.
  • Network Fees: Blockchain network fees are typically paid by the buyer at the time of payment and vary by chain conditions.
  • Merchant Credit: You may maintain a platform credit balance to cover service fees and optional add-ons; unless required by applicable law, credits are non-refundable.

6.a Loading Credit

BiglyPay supports two ways to load your platform credit (used for service fees and optional add-ons):

  • Manual Load: Send funds to your designated top-up address found on Dashboard Top-up Button, and we’ll monitor the blockchain and credit your balance upon confirmation.
  • Auto Load (default): When your balance is low, the next confirmed payment may be automatically applied to your credit instead of being routed to your settlement wallet, so your service continues without interruption.

Managing Auto Load: You can turn Auto Load off at any time in Dashboard > Settings > General. When disabled, you must Load credits manually to avoid suspension.

Notifications: We may notify you when credit is low, when Auto Load is triggered, and if your balance reaches a suspension threshold.

Refunds: Unless required by applicable law, credits are non-refundable.

7. Security

We apply industry-standard safeguards to protect the Service. However, no system is 100% secure. You acknowledge that you are responsible for the security of your wallets and infrastructure. Report security issues to support@biglypay.com.

8. Privacy

Your use of the Service is subject to our Privacy Policy. We minimize personal data and focus on payment metadata necessary for monitoring, fraud prevention, and compliance.

9. Availability, Updates & Changes

  • We may modify or discontinue features with or without notice to improve reliability, security, or compliance.
  • We may update these Terms; changes take effect upon posting. Material updates may be communicated via email or dashboard.

10. Disclaimers & Limitation of Liability

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, BiglyPay disclaims all warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, data, goodwill, or other intangible losses. Our aggregate liability under these Terms will not exceed the fees paid by you to BiglyPay in the twelve (12) months preceding the event giving rise to the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, present undue risk, or where required by law. Provisions that by their nature should survive termination (e.g., limitations of liability) will survive.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of the United Arab Emirates, as applicable to BiglyPay FZCO, without regard to conflict of laws principles. Courts located in the UAE shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.
